In the framework of a performance which opens an educational workshop to the public, Rainer Kirberg for haus.0 stages an authentic legal case drawn from German jurisdiction. Following the principles for television, Kirberg sets up the second floor of the Künstlerhaus as a courtroom and stage for a four-camera shoot. The edited video was presented in >redirect, along with trial materials and M/SOS workshop working papers.

In contrast to the popular real life TV formats like Court TV, haus.0’s staging of A Trial – The Indictment against Mr. Noethen does not simulate reality, but shows an actual simulation (“mock trials”). Every German junior laywer’s professional training practice includes participation in such trials. In this exercise, each student is assigned a role inside of the trial: judge, attorney, lawyer, prosecutor, defendant and witnesses. For the case chosen for this performance there was no applicable law nor a precedence. The reasons become clear during its process. They cast light on a very specific dilemma of law as normative power applied to a segment of societal reality which has not yet been defined juridically.

At the same time, the performance allows for a view onto a cultural-economical sector which renders human’s double existence as a being determined socially as well as biologically: the funeral industry. Transgressing the world of legal jurisdictions, A Trial – The Indictment against Mr. Noethen opens up a wide-ranging context of legal, philosophical and ontological questions.

A Trial – The Indictment against Mr. Noethen was conceived and developed in the framework of the M/SOS workshop series which were held by haus.0 in 2001. These workshops were based on an open and discursive format oriented along script based strategies belonging to issues of social and political forms of representation. In the framework of the M/SOS workshops, such presentations of Peter Weiss’ Marat/Sade and Peter Watkins Punishment Park / La Commune took place.

Auszug aus der Vernehmung Noethen:

Ich möchte – nachdem ja jetzt alles heraus ist – Angaben machen.
Ich arbeite seit dem 1. 1. 2000 im Städtischen Krematorium. Meine Aufgabe besteht darin, den Sarg mit Inhalt
der Verbrennung zuzuführen, anschließend die Asche unter dem Schüttelrost einzusammeln, abzufüllen und zu beschriften etc., sowie den ganzen Verwaltungskram dann zu erledigen. Ausser mir ist dort noch ein Techniker beschäftigt, eine halbe Verwaltungskraft und der Hausmeister. Ich arbeite also ziemlich selbständig und und unüberwacht. Schon sehr bald kam ich auf die Idee, die schön, aufwendig und kunstvoll gefertigten Särge nicht zu vernichten. Wissen Sie, für mich war das richtig belastend, jeden Tag nur zu vernichten, was andere sorgsam und mühselig gefertigt haben. Das sind ja Werte, und auch Werke – fast KUNSTWERKE. Und dann sieht man diese Bilder von den zurückgehenden Wäldern, von Umweltbelastungen durch Abgase und Qualm. Meine Arbeit kam mir dann richtig unökologisch und auch unökonomisch vor.
So entschloss ich mich, im Februar 2000 schon, abends den Sarg in meinen Kombi zu laden – am Besten im Dunkeln – und ihn zur Schreinerei Kunz zu bringen. Die Dinger waren ja wie neu. Und ob der Verblichene mit oder ohne Kiste die Rutsche "ins Fegefeuer" bewältigt, das ist doch egal. Die Angehörigen wissen ja nicht einmal, wie das bei uns normal zugeht. Denen ist das doch egal. Und den Toten ja ohnehin. Versteht sich doch von selbst, oder?
Nun ja, die Särge wurden dann beim Kunz noch mal überpoliert und dann für 4000,- DM im Schnitt – üblicher Preis heute – verkauft, richtig so mit Mehrwertsteuer, Rechnung und so. Hat dem Kunz nur halt viel Arbeit gespart, und natürlich das ganze Material, Holz, Lacke und so. Und der Erlös wurde zwischen uns geteilt.
Ich denke nicht, dass ich mich da strafbar gemacht haben kann, was soll das denn sein. Waren doch alle zufrieden.
Es ist richtig, dass ich zweimal mit so ‘nem Sarg hinter mir im Auto kontrolliert worden bin. Das war Karfreitag 2001 und dann noch mal am 1. Juli 2001 – da ist mir so ein Heini reingefahren in das Auto. Die letzten Särge habe ich in den Fällen Arndt und Hoeriz "geklemmt".
